General Terms and Conditions of Contracting. Enrollment Contract

These General Terms and Conditions of Contracting are an integral part of the enrollment contract formalized between MUNDAE INTERNATIONAL UNIVERSITY (hereinafter, the UNIVERSITY) and the STUDENT, together with the specific economic conditions applicable to the contracted academic program and, where appropriate, the corresponding academic and economic annexes. The formalization of enrollment by electronic means, telephone, or any other distance contracting technique requires that the STUDENT has previously been able to review these Conditions, the essential information of the program, the total price and payment method, the duration, cancellation conditions, and the right of withdrawal when applicable. The UNIVERSITY will send confirmation of the contracting on durable media.

Prior to formalizing the enrollment, these General Terms and Conditions will be made available to the STUDENT for their knowledge, reading, and acceptance, and may also be consulted on the UNIVERSITY's official website, www.mundaeuniversidad.com. By signing the enrollment document or any other express acceptance mechanism enabled by the UNIVERSITY, the STUDENT declares having received or had access to these General Terms and Conditions, having been able to know their content prior to contracting, having read and understood them, and accepting them fully and without reservations, being bound to comply with them during the term of the contractual relationship, without prejudice to the rights that correspond to them under the applicable regulations.

1. Object, program, and duration

The enrollment aims to provide the educational services corresponding to the specific academic program chosen by the STUDENT. The UNIVERSITY will deliver the program according to the approved curriculum, its academic regulations, the authorized modality, and the current academic planning and calendar.

The contractual duration corresponds to the academic period or, when the complete program has been contracted, to the duration foreseen in the curriculum, without prejudice to the causes of suspension, withdrawal, cancellation, termination, or academic modification provided in these Conditions and the applicable university regulations.

2. Pre-contractual information and enrollment formalization

Prior to contracting, the UNIVERSITY will provide the STUDENT with clear and sufficient information about the essential characteristics of the program, access requirements, modality, duration, total price, payment method, external financing conditions when applicable, cancellation policy, and withdrawal rights when appropriate.

Enrollment will be formalized once the STUDENT has expressly accepted these General Terms and Conditions by signing the enrollment document or by any other express acceptance mechanism enabled by the UNIVERSITY, and the UNIVERSITY has verified, as appropriate, compliance with admission requirements and payment of the enrollment fee by bank receipt or corresponding external financing instrument.

Once these requirements are met, the UNIVERSITY will proceed to administratively formalize the enrollment and register the STUDENT in its academic systems. The enrollment confirmation and corresponding contractual documentation will be sent to the email provided by the STUDENT.

When contracting is done through an electronic interface that implies a payment obligation, the final step of the process will clearly and unequivocally identify that the action entails a payment obligation.

3. Academic requirements and documentation

The STUDENT declares that the information and documentation provided are truthful and commits to providing the originals or verifiable documents requested within the communicated deadlines. Admission or enrollment may be conditional when official access requirements verification is pending.

If, once enrollment is formalized, it is found that the STUDENT does not meet the academic or legal requirements demanded for access to the program, the UNIVERSITY will proceed to cancel the enrollment. When this circumstance is not attributable to the STUDENT, the UNIVERSITY will refund the amounts paid corresponding to services not rendered.

When the failure to meet access requirements results from the provision of false, inaccurate, or essentially omitted information or documentation by the STUDENT, the UNIVERSITY may cancel the enrollment, without prejudice to liabilities and claims for damages that, duly proven, may correspond under the law.

4. Price, payment, and contracting the complete program

The applicable price will be the one expressly indicated in the individual enrollment document or economic annex. This document will identify the total price, applicable taxes or fees, included concepts, payment method, and, if the price is paid in advance for the entirety of a multi-year program, the economic allocation of the price to each academic year, academic period, or service block.

The UNIVERSITY may offer, when compatible with applicable regulations, a global or discounted price for advance payment of the entire program. Advance payment does not definitively accrue the price corresponding to future services not yet rendered and will be subject to the withdrawal, cancellation, and settlement rules provided in these Conditions. The possibility of paying this amount by single payment, installment payment, or any other financing modality will be considered exclusively as a payment method, without implying the division of the course price into independent services nor altering the total amount corresponding to the contracted academic period.

When the STUDENT opts to finance the enrollment payment through an external financial entity, such financing will constitute an independent contractual relationship unrelated to the UNIVERSITY, formalized directly between the STUDENT and the financial entity. The UNIVERSITY will not be a party to the financing contract nor assume any responsibility regarding its conditions, costs, interests, payment obligations, or any other consequences derived from it. The contracting, modification, cancellation, or termination of such financing will be governed exclusively by the agreement between the STUDENT and the financing entity and by the applicable regulations.

The UNIVERSITY does not intervene in granting external financing nor conditions the contracting of its educational services on entering into a financing contract with a specific entity, allowing the STUDENT to freely choose the payment method or, where appropriate, the entity with which they decide to finance it.

5. Non-payment and suspension of services

The STUDENT must pay the amounts corresponding to the enrollment in the amounts and dates established in the specific economic conditions of the enrollment contract.

In case of total or partial non-payment of a due amount, the UNIVERSITY will require the STUDENT to regularize it, granting a reasonable period to make the payment. If this period elapses without remedying the breach, the UNIVERSITY may temporarily suspend access to academic and administrative services linked to the enrollment, after notifying the STUDENT, until the situation is regularized.

If non-payment persists, the UNIVERSITY may terminate the contractual relationship and cancel the enrollment, being able to claim the due and unpaid amounts corresponding to services rendered, academic periods already started, and other specific, reasonable, and itemizable costs incurred as a consequence of the enrollment.

In case of termination due to non-payment, the UNIVERSITY will carry out the corresponding economic settlement. For these purposes, it may claim the due and unpaid amounts corresponding to services effectively rendered, academic periods already started, and specific and itemizable costs effectively incurred as a consequence of the enrollment. Amounts that may have been paid in advance will be applied to this settlement. Refunds will only proceed when, once the settlement is made, a balance in favor of the STUDENT results corresponding to future services or academic periods not rendered.

6. Right of withdrawal in distance contracting

When the STUDENT has the status of consumer or user and Spanish or European Union regulations on distance contracting apply, they may withdraw from the enrollment without needing to justify their decision within fourteen (14) calendar days following the contract conclusion, without penalty, except for legally required costs for services started at the STUDENT's express request during that period.

Withdrawal may be communicated by any unequivocal statement addressed to the UNIVERSITY via email at atención.alumno@mundaeuniversidad.com, using the following withdrawal form model: “To the attention of Mundae International University: I hereby communicate that I withdraw from the enrollment contract formalized on date__________. Student Name. Student Address. Signature and Date.”

Once the UNIVERSITY receives the withdrawal communication and verifies that its exercise has been made according to the requirements and within the legally established period (14 calendar days from contract formalization), it will proceed to process the corresponding withdrawal and, where appropriate, refund the amounts due. The refund will be made without undue delay and, in any case, within a maximum period of fourteen (14) calendar days from the date the University was informed of the withdrawal decision, in accordance with applicable consumer protection regulations.

7. Voluntary cancellation, withdrawal, and economic settlement

Once the legal withdrawal period has elapsed, the STUDENT may request at any time the voluntary cancellation or definitive withdrawal of their enrollment in writing addressed to the UNIVERSITY via email at atención.alumno@mundaeuniversidad.com. The cancellation request will give rise to an economic settlement based on the services effectively rendered, academic periods already started, and itemizable and effectively incurred costs by the UNIVERSITY that had been previously informed to the STUDENT.

When the price of a multi-year program has been paid in a single payment, once the legal withdrawal period has elapsed, the STUDENT's withdrawal or voluntary renunciation will not entitle them to a total or partial refund of the amounts corresponding to the first academic year in which they formalized their enrollment. The UNIVERSITY may refund amounts attributable to future academic years or periods not yet started.

If the cancellation is due to a breach attributable to the UNIVERSITY, an institutional decision not to offer the program, or the impossibility of continuing to provide it under the essential contracted terms, amounts corresponding to services not rendered will be refunded, without prejudice to other rights that may correspond to the STUDENT under applicable regulations.

In cases of disciplinary expulsion or termination due to breach by the STUDENT, a proportional settlement of services rendered and advance payments will also be made, without prejudice to additional liabilities that, where applicable, are legally enforceable and duly proven.

8. Academic modifications, force majeure, and continuity of service

The UNIVERSITY may introduce justified organizational, technological, or methodological modifications that do not substantially alter the nature of the program, its learning outcomes, its official status, or the essential contracting conditions. Substantial modifications will be communicated with reasonable advance notice and may not be unilaterally imposed when they significantly harm the STUDENT's economic or academic rights.

When force majeure or unforeseen circumstances make it necessary to temporarily modify the form of provision, the UNIVERSITY will adopt reasonable measures to ensure continuity and academic quality. If the modification substantially prevents receiving the contracted service, legally corresponding rescheduling or termination measures will apply.

9. Personal data protection

The STUDENT's personal data will be processed in accordance with the applicable data protection regulations and the current Privacy Policy of Mundae International University, available at www.mundaeuniversidad.com/politica-de-privacidad/.

Processing necessary to manage admission, enrollment, invoicing, collections, teaching, evaluation, academic records, internships, issuance of degrees and certificates, security, and compliance with legal obligations will be based on the execution of the contractual relationship, compliance with legal obligations, and, when applicable, legitimate interest. Enrollment will not be conditioned on providing consents that are not necessary for the execution of the educational service.

Commercial communications, promotional use of the STUDENT's image or voice, and any other processing requiring consent will be subject to separate, specific, free, and revocable authorization. Refusal or withdrawal of consent for these purposes will not affect the continuity of contracted educational services when such processing is not necessary for their provision.

The STUDENT may exercise their rights through the data protection channel indicated in the Privacy Policy. International transfers and data communications to collaborating entities will be carried out with the legal basis and guarantees required in each case.

10. Intellectual property, image, and teaching materials

Teaching materials, trademarks, designs, platforms, and content owned by the UNIVERSITY or third parties will be protected by applicable regulations and are provided to the STUDENT for personal academic use. Their reproduction, distribution, or public communication outside legally permitted or expressly authorized uses is prohibited.

The UNIVERSITY's use of the STUDENT's work for dissemination, promotion, or publication purposes other than evaluation and academic management will require, when legally applicable, specific authorization or a separate license respecting the STUDENT's authorship and rights.

11. Applicable academic regulations

The status of student and academic organization will be governed by Costa Rican university legislation, CONESUP provisions, and the internal regulations of Mundae International University in force and published through institutional channels, as applicable to the program attended.

12. Applicable law and jurisdiction

Academic organization, official validity of studies, and university relationship will be governed by Costa Rican regulations and the institutional regulations applicable to Mundae International University.

In contractual relationships with consumers residing in Spain or another European Union State, the choice of Costa Rican law will not imply loss of protection granted by the mandatory provisions of the law of the consumer's habitual residence when, according to applicable private international law rules, the UNIVERSITY directs its activities there. Likewise, jurisdiction will be determined according to mandatory consumer protection rules applicable, without imposing on the STUDENT submission that deprives them of legally recognized forums in their favor.

13. Partial nullity and modification of conditions

The nullity or ineffectiveness of a stipulation will not affect the validity of the rest of the contract.

Modifications to these Conditions will not have retroactive effects on already concluded contracts unless they are more favorable to the STUDENT or required by a mandatory rule. Modifications affecting essential conditions of an existing contract must be communicated and, when appropriate, accepted according to the law.
